SUBSCRIPTION TERMS AND CONDITIONS

The parties to this instrument are, on one side, Nectar Star LLC, a company legally constituted under the laws of the State of Wyoming, with its headquarters at 30 N Gould St Ste N, Sheridan, WY 82801, USA, hereinafter simply referred to as NECTAR STAR, and on the other side, the individual or legal entity identified in the Electronic Registration by their Subscriber Code, hereinafter simply referred to as the SUBSCRIBER.

  1. OBJECT OF THE TERMS AND CONDITIONS.

This instrument aims to establish the terms and conditions of the agreement celebrated between NECTAR STAR and the SUBSCRIBER (Contracting Party) for the provision of the products and/or services contracted by them (“Products/Services”), through their subscription.
1.1. Detailed information about the Products/Services is available to the SUBSCRIBER on the website https://www.california-tv.com.

  1. SUBSCRIPTION CODE:

NECTAR STAR will grant the SUBSCRIBER a “Subscriber Code” for identification with the Customer Service, which will be a personal and non-transferable code. The SUBSCRIBER can find it after order confirmation and at the time of shipment or access to the Products/Services.

  1. DELIVERY

The delivery or availability of the Products/Services will begin with inImmediate, counting from the date of confirmation of the contract and payment.
3.1. For the delivery period of the Products/Services to be observed, the SUBSCRIBER must completely inform all their address data:
a) Street (e.g., street, avenue, square, etc.);
b) Property number;
c) Any complement (e.g., apt., house, rear unit, etc.);
d) Neighborhood;
e) City;
f) State;
g) Zip Code.

  1. CONTRACTING, PRICES, PAYMENT METHODS

The SUBSCRIBER's contracting must be carried out through the NECTAR STAR "website", https://www.california-tv.com, where all available Subscription Plans will be listed, as well as their specific conditions.
4.1. The SUBSCRIBER must choose the Subscription Plan they wish to contract, and it is certain that its specific conditions (Values, Terms, Payment Conditions, etc.) on the website will become an integral and inseparable part of this instrument.
4.2. The SUBSCRIBER expressly declares and guarantees, for all legal purposes: (I) to have the legal capacity to enter into this instrument and to use the Product/Service; (II) to recognize that this instrument is formalized, binding the parties, with the contractual confirmation, which will be done by clicking in the space reserved for this purpose on the NECTAR STAR website.
4.3. As consideration for the object of this contract, the SUBSCRIBER must pay NECTAR STAR the amount corresponding to the contracted Plan, according to the option chosen at the time of purchase and in effect at the time of purchase.
4.4. The payment method will be chosen by the SUBSCRIBER from those available on the "website" for the chosen Plan, where the billing frequency and any applicable charges will also be listed.

  1. DATABASE.

The SUBSCRIBER declares that they are aware that, upon contracting a Product/Service subscription, they become part of the NECTAR STAR database, through which they may receive information from NECTAR STAR and other reputable companies with which it has a relationship. If the SUBSCRIBER is not interested in receiving this information, they have the right to express their opposition, simply by communicating this decision to Customer Service.
5.1. The inviolability and confidentiality of the registration data of all its SUBSCRIBERS are ensured by NECTAR STAR. All your information is stored under the most rigorous security criteria in the company's database and is treated in accordance with applicable legislation. Under no circumstances are personal details provided to third parties unrelated to the provision of the services, which are the object of this instrument, only generic data used for sending direct mail, email, newsletters, and only when authorized by the SUBSCRIBER.

  1. SUBSCRIBER CUSTOMER SERVICE.

NECTAR STAR makes Customer Service available to the SUBSCRIBER and provides the following contact channels:

  1. TERM.

This instrument is celebrated for a term corresponding to the subscription cycle chosen by the SUBSCRIBER at the time of contracting, namely: Monthly (1 month), Quarterly (3 months), Semiannual (6 months) or Annual (12 months). The contract is automatically renewed for successive periods equal to the one initially chosen, upon confirmation of renewal by the SUBSCRIBER, according to the procedure provided for in the next item.

  1. RENEWAL PROCEDURE:

NECTAR STAR adopts the programmed subscription renewal procedure, directed exclusively to the SUBSCRIBER, ensuring ease and speed in renewal.
8.1. At least 30 (thirty) days before the end of each subscription cycle, NECTAR STAR will send the SUBSCRIBER communications to remind them of the date and amount of the next charge and the possibility of cancellation, which will contain all information related to the new contractual term. Renewal will only be carried out upon confirmation of payment for the following cycle.
8.2. If the SUBSCRIBER is not interested in renewing their subscription, they simply need to cancel the automatic renewal through their customer area on the website https://www.california-tv.com or contact Customer Service via email: suporte@californiatv.

  1. CANCELLATION AND REFUND.

NECTAR STAR assures the SUBSCRIBER the possibility of canceling the automatic renewal at any time, by means of prior notice by the SUBSCRIBER through their customer area on the website or via email to suporte@californiatv.com.br
9.1. In case of cancellation during a pre-paid cycle, no proportional refund will be offered, and the services will remain active until the end of the paid contractual period (monthly, quarterly, etc.). Cancellation will result in non-renewal for the next cycle.
9.2. Refunds are only considered in specific cases and according to the refund policy disclosed on the website, and provided they are requested within 07 (seven) days after the charge, in accordance with applicable legislation.

  1. TERMINATION.

The subscription may be canceled and this instrument terminated in the event of a contractual breach, if the breaching party does not correct the default, after notification.
10.1. If the SUBSCRIBER does not pay the amount due within the period stipulated in a notification to be sent by NECTAR STAR, this instrument may be terminated with the immediate suspension of the delivery or access to the Products/Services.

  1. CHANGES TO THE TERMS AND CONDITIONS.

Any changes that result in a financial burden to the SUBSCRIBER will be made upon prior communication to them, who may express their agreement, by any available means, renegotiate such changes, or either party may terminate the agreement if they cannot reach an agreement.

  1. JURISDICTION.

The SUBSCRIBER is assured the right, if necessary, to recourse to the court of their place of residence, for any doubts and questions arising from this instrument, with the parties waiving any other, no matter how privileged it may be.

  1. APPLICABLE LAW AND REGISTRATION.

These Terms and Conditions shall be governed and interpreted in accordance with the laws of the State of Wyoming, USA.
This instrument is registered in the files of Nectar Star LLC.
